Acceptance of terms

These Terms of Service ("Terms") form an agreement between you and Seneia Studio LLC ("Seneia Studio", "we", "us", or "our") and govern your access to and use of the Milestold mobile and web applications and related services (collectively, the "Service").

By creating an account, subscribing, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Who can use Milestold

You must be at least 16 years old to create an account. By using the Service, you confirm that you meet this requirement and that the information you provide is accurate.

You are responsible for keeping your account credentials secure and for all activity under your account. Tell us promptly at contact@seneiastudio.com if you believe your account has been compromised.

The Service

Milestold is an audio journal for runners. You record a voice note after your run; the Service transcribes it, summarizes it, and stores the entry in your journal, along with details it extracts from what you said.

We may add, change, or remove features over time. If a change materially reduces the core functionality of the Service, we will let you know in the app or by email.

Subscriptions and billing

Milestold may be offered as a subscription that you purchase directly from us, billed in advance on a recurring basis (monthly or yearly) until you cancel.

Your subscription renews automatically at the end of each billing period unless you cancel before that date. You can cancel at any time from your account settings; cancellation takes effect at the end of the current billing period, and you keep access until then.

We may change subscription prices with reasonable advance notice. The new price applies from your next billing date, and continuing your subscription after that date constitutes acceptance.

Payments are non-refundable except where required by law or where we determine, at our discretion, that a refund is appropriate. If we suspend or terminate your account without cause, we will refund the unused portion of your prepaid subscription.

Your content

You own everything you record and write in Milestold — your voice notes, transcripts, summaries, and journal entries ("Your Content").

To run the Service, you grant us a limited license to process and store Your Content: to transcribe and summarize it, to back it up, and to display it back to you. This license exists only to provide the Service and lasts only as long as needed for that purpose. We do not sell Your Content or use it to advertise to others.

You can export or delete Your Content from the app. When you delete content, it is removed from active storage; backups may retain it for a limited period before it is fully purged.

Acceptable use

You agree not to misuse the Service. That means you will not:

• Use the Service for unlawful purposes or to store unlawful content.
• Infringe the rights of others, including intellectual property and privacy rights.
• Interfere with or disrupt the Service, or attempt to access it other than through its intended interfaces.
• Reverse engineer the Service except where that restriction is prohibited by law.

Privacy

We collect and use information as described in our Privacy Policy, which is part of these Terms. Location data in Milestold is optional: the Service may save one approximate starting point per entry if you allow it, and it never tracks your movement.

Health disclaimer

Milestold is a journaling tool. It is not a medical device and provides no medical advice. Any observations, summaries, or details the Service produces are transcriptions of what you said — not diagnoses, training prescriptions, or health guidance.

Always consult a qualified professional before making decisions about your health, training, or exercise. Use the Service at your own risk.

Intellectual property

The Milestold name, logo, software, design, and all related materials are owned by Seneia Studio LLC and protected by intellectual property laws. You may not copy, modify, or distribute them without our written permission, except as the Service allows.

These Terms do not grant you any right to use our trademarks beyond identifying the Service.

Feedback

If you send us ideas, suggestions, or bug reports — for example through Settings → Feedback in the app — you grant us a perpetual, royalty-free license to use them to improve the Service, without any obligation to you.

Termination

You can stop using the Service and delete your account at any time.

We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue the Service. Where reasonably possible, we will give you advance notice and a chance to export your journal entries first.

When your account is terminated or deleted, Your Content is handled as described in these Terms, and the portions of these Terms that should survive — such as intellectual property, disclaimers, and limitation of liability — remain in effect.

Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or that transcriptions and summaries will always be accurate. Keep your own backup of anything that matters to you.

Limitation of liability

To the maximum extent permitted by law, Seneia Studio LLC will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the Service.

Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the twelve months before the claim or one hundred US dollars ($100).

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

Indemnification

You agree to indemnify and hold harmless Seneia Studio LLC from claims, damages, and expenses arising from your use of the Service in violation of these Terms or applicable law.

Changes to these terms

We may update these Terms from time to time. When we do, we will change the date at the top of this page and, for material changes, notify you in the app or by email.

Continuing to use the Service after changes take effect means you accept the updated Terms. If you do not accept them, you can stop using the Service and cancel your subscription.

Governing law and contact

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law rules. Any dispute arising from these Terms will be brought exclusively in the state or federal courts located in Delaware, and you consent to their jurisdiction.
